Terms for Custom Design
In order for us to properly schedule work we must obtain agreement from our customers that once they are booked into our schedule, we will work on their project. Many times clients don’t realize that there is much work for them to do as well. For example, clients will need to provide us documents of terms, images of products, product lists, category names, logins and passwords, etc. In addition, clients will need to review our design concept and give us specific instructions on placement of elements, colors, and other things that are necessary for us to move forward. We require that clients will answer our emails in a timely manner. aGenius and the client must work together to complete the website in a timely manner. We agree to work expeditiously to complete the website no later than 45 Business DAYS the project start date.
Payment Policy for Web Site Development
50% payment of your estimated total is paid as a deposit prior to beginning work. All deposits are non-refundable.
The final payment is due immediately upon installation of the web development project and before the final completed web site goes live or upon installation of 80% of the site, whichever is reached first. Once the site is deemed 80% final touches will be put upon the site after payment is made in full.
Should aGenius not be provided everything needed in order to complete the web site within 45 days of the start date, an invoice will be e-mailed out. Payment in full must be made within 7 business days of the date on the invoice in order to continue work on the site. aGenius will continue working on your site once your balance is $0.00.
Pause in web site development
A request to pause web site development must be made if your web site has not drawn to completion 45 days from the start date. Prior to putting in for a Pause in Development, your balance must be paid in full. Delays can’t exceed a period of 30 days. Any delay requested by the client that exceeds 30 days will be considered a cancellation, and hence charges for the number of hours accumulated during web site development before the request to pause is made are assessed at our current billable rate. *If you are paid in full, you will not be charged again. We will continue working on your site once your balance is $0.00.
Should a web site be disconnected due to non-payment a reconnect fee of $125.00 is applied to the balance owed. We will continue working on your site once your balance is $0.00
Design Approval
Clients must approve designs before installation can be done. In some instances this includes verbal approval. Normally we provide a design concept based upon our discussion and understanding of what a client wants. There are times when we are not clear or when a client changes their minds about what they want. All design changes must be requested within 7 days of each mockup. In cases where changes are made repeatedly prior to installation, we reserve the right to charge the current billable rate after 2 sets of changes.
Feature Agreement
Normally we agree in advance of features to be added to a website. In some cases clients ask us to add features such as logos, search boxes, additional links, additional pages of text, etc. to the site. These features must be known during the design phase of the job and must be consistent with the quoted project. When features are added after the design phase, during installation, additional charges are billed at the current billable rate.
Changes to Submitted Text. Please send us your final text. Time required to make substantive changes to client-submitted text after the webpages have been constructed will be additional, billed at the hourly rate.
Legal Stuff. aGenius does not warrant that the functions contained in these webpages or the Internet website will meet the client’s requirements or that the operation of the webpages will be uninterrupted or error-free. The entire risk as to the quality and performance of the webpages and website is with client. In no event will aGenius be liable to the client or any third party for any damages, including any lost profits, lost savings or other incidental, consequential or special damages arising out of the operation of or inability to operate these webpages or website, even if aGenius has been advised of the possibility of such damages. If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.
Our current billable rate is $85.00 per hour.
